SUCCESSION & INHERITANCE
Wills, inheritance and disputes between heirs
At Carabott Advocates we advise individuals and families on wills, inheritance rights, inherited property and disputes between heirs.
Succession matters frequently involve more than the interpretation of a will. Questions may arise over property, debts, donations made during the deceased’s lifetime, the rights of different heirs and the eventual division of the estate.

Wills and succession planning
We advise clients on the legal implications of proposed testamentary arrangements and the issues that should be considered before instructions are given to a notary.
Where a will already exists, we can advise on its interpretation and how its provisions may affect the heirs and beneficiaries.
Intestate succession
Where a person dies without leaving a valid will, the estate devolves according to the applicable laws of intestate succession.
We assist family members in understanding their position, identifying the legal issues that may arise and coordinating with the notary handling the succession where required.
Inherited property
It is common for property to pass to several heirs jointly. Problems may arise when they disagree over its use, maintenance, sale or division.
We advise co-heirs on their respective rights and assist with negotiations concerning the administration, transfer or partition of inherited property.
Disputes between heirs
Disagreements may concern the validity or interpretation of a will, entitlement to a share of the estate, property held by one heir, transactions made during the deceased’s lifetime or the way in which the estate is being administered.
We examine the relevant wills, deeds, declarations, records and correspondence and advise on whether the matter can be resolved between the parties or requires formal proceedings.
Inheritance disputes are often legally complex and personally difficult. They require firm advice, but also an understanding of the family circumstances and the consequences of prolonged proceedings.
Our approach:
“Succession matters are often personal as well as legally complex, particularly where property and family relationships are involved.
We approach them with care and clarity, while remaining focused on the client’s rights and the practical way forward.”
